Phillip Martin

  • Attorney

Phil leads the firm’s bankruptcy practice and represents parties in bankruptcy-related matters and litigation across the country in a number of industries. He serves as national bankruptcy counsel for several clients and represents them in adversary proceedings, in pursuing claims, and on creditors’ committees from California to Delaware. He has drafted extensive workout and forbearance agreements to resolve complex disputes and to avoid the expense and disruption of bankruptcy proceedings. Phil has successfully defended clients involuntarily brought into the bankruptcy courts, and he has litigated preference actions, fraudulent conveyance actions, and other bankruptcy adversary proceedings. He has also represented individual owners faced with issues arising from failed corporate businesses.

Phil also maintains a significant commercial litigation practice and has represented both plaintiffs and defendants in litigation nation-wide. He has represented clients in contract/commercial disputes, insurance coverage disputes, personal injury matters, consumer protection claims, and property disputes. He has pursued aggressive discovery, taken and defended depositions, handled substantive legal arguments in court, brought cases to trial, and authored appellate briefs in these varied practice areas.

Phil always endeavors to maintain a business focus with his clients and works to efficiently address their legal issues in the context of their business and their needs. Over the years, Phil has become integrated in many of his clients so he is able to assist early on with issues to help avoid larger problems down the road. This allows clients to focus their energy and resources on building their businesses instead of being consumed by legal matters.

Community Involvement: Phil is actively involved in the local music and arts community and is a supporter of many local organizations that provide opportunities for young people to develop their artistic passions. He plays bass with a local all-volunteer jazz big band that plays community events.

Phil is married with three children. His interests include guitar, bass, Lego, and the Boston Celtics.
